Court challenges filed seeking to have Mastriano, Perry removed from May primary ballot

Watching Out for Election Subversion

by Neil Goldstein, Good Government Justice Team Leader

Beware: Pennsylvania could well be facing one of the most serious matters in history involving the state legislature, part of an emergency for American democracy.

Many knowledgeable observers warn that the legislature will be, or may already be, part of a national Republican effort to use a crazy, fringe legal doctrine to help subvert the 2024 presidential election results if the GOP candidate legitimately loses.

It’s the Independent Legislature Doctrine, which says state legislatures have absolute power to appoint electors. If that happens here and in other battleground states, the U.S. could end up with a president who was chosen not by voters but by partisan state legislators.

As one elections expert put it bluntly to the New Yorker, “I’m scared shitless.”

Possibly related is the PA Senate Republicans’ so-far ill-defined “investigation” of the 2020 election. Election experts fear the effort won’t improve voter confidence, as its proponents argue, but rather will sow doubt and spread misinformation, playing to Donald Trump’s base while raising questions that could discourage people from voting. It also could soften the ground for election subversion.

What’s more, Steve Bannon has been successfully using his popular podcast to promote a Trump-loyalist takeover of the GOP, from precinct positions on up, including in PA’s Cumberland County.

What can we do about this threat?

The Washington Post’s Jennifer Rubin interviewed elections scholar Richard Hasen, who said, in part:

Possible legislative reforms include improved transparency with paper ballots and audit standards; reform of federal law to remove the potential for substituting legislatures’ pick for that of state voters and limit frivolous challenges; safeguards to ensure that election administration remains in the hands of nonpartisan officials; increased penalties for threatening election officials or tampering with results; and measures to counter election disinformation.

Beyond legislative changes, we may need to organize for political action to re-enforce rule-of- law norms in elections. This means: advocating for laws that deter election subversion and against laws making stolen elections easier; politically opposing would-be election administrators who embrace false claims about stolen elections; and preparing for mass, peaceful protests in the event of attempts to subvert fair election outcomes.

We’ll be vigilant about this threat. Please help us stay on top of it — if you see anything that makes you think PA legislators are moving in this direction, send a heads-up to neiljgold0@gmail.com and tomulrich41@gmail.com.

Hold Them Accountable

While PA lawmakers continue to argue among themselves, (Corman, Mastriano, & Dush) an Arizona-like audit of the 2020 election is still being planned.

Call Corman and Dush and let them know 1) PA 2020 election was most secure ever, and 2) this is a waste of tax payer money and legislator’s time.

Contact your legislators, no matter if a Democrat or a Republican. Tell them to stop this nonsense and get to work for the people of PA.

Commonwealth V. Dush and Corman

On October 4, 2021, the ACLU of Pennsylvania filed a motion to intervene on behalf of three advocacy organizations and eight individual voters in Commonwealth v. Dush and Corman, a lawsuit filed by the Pennsylvania attorney general challenging subpoenas issued by the state Senate Intergovernmental Operations Committee to the Department of State for the personally identifying information of all registered voters in Pennsylvania. With co-counsel from national ACLU’s Voting Rights Project and the law firm Schnader Harrison Segal & Lewis LLP, the ACLU of Pennsylvania argues that the privacy rights of the voters and the members of Common Cause PA, the League of Women Voters of PA, and Make the Road PA will be impacted by the outcome of the case.

If granted by the Commonwealth Court, the intervenors will be parties to the case on the side of the attorney general and the Secretary of State, meaning that their attorneys will participate in all court proceedings to help prevent the disclosure of 9 million Pennsylvania voters’ personal data, including driver’s license numbers and the last four digits of social security numbers.

On September 15, the Intergovernmental Operations Committee issued subpoenas demanding a long list of personal data of Pennsylvania’s registered voters, including names, addresses, dates of birth, driver’s license and non-driving identification numbers, and partial Social Security numbers. Neither when the committee issued the subpoenas nor to this date has the committee publicly explained how the data would be protected or even identified the private company that would house and analyze the data.

In their motion to intervene, the voters and advocates argue that the release of personally identifying information to the committee and a private company violates their right to privacy under the Pennsylvania Constitution.

Let Your Voice Be Heard

It took Pennsylvania three weeks to certify the 2020 Presidential election. Many of our Senators and even more of our Representatives continue to promote “the big lie” that the election was not fair and was stolen.

Here is a list of the original non-certifiers in Pennsylvania. HOLD THEM ACCOUNTABLE. ADD THE LIST OF NON-CERTIFIER NAMES.
